Part 1. End user licence agreement
This end user licence agreement (“Agreement”) is between you and Moonjump Pty Ltd (“Moonjump”, “we”, “us”) of Canberra, Australia. It covers the video game Haul Yeah!, including its updates and any downloadable content (together, “the Game”). By installing or playing the Game you agree to this Agreement. If you don’t agree, don’t install or play the Game, and see the store you bought it from about a refund.
The short version
- You can install and play the Game for your own enjoyment.
- Please don’t copy, resell or redistribute it, or take it apart to reuse its parts.
- You’re welcome to stream it, make videos of it and share screenshots, including monetised ones.
- Your rights under consumer law, including the Australian Consumer Law, aren’t affected.
1. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own non-commercial entertainment. You also have to follow the rules of the platform you got the Game from. The Game is licensed to you, not sold. Moonjump keeps all rights not expressly granted in this Agreement.
2. Platform terms
If you got the Game on Steam, the Steam Subscriber Agreement also applies. On a console or another store, that platform’s terms apply. Purchases, refunds and your platform account are governed by the platform’s terms. If they conflict with this Agreement on those matters, the platform’s terms prevail.
3. What you can’t do
Except where the law allows it regardless of this Agreement, you must not:
- copy, sell, rent, lend, sublicense or distribute the Game, or make it available over a network for others to play without their own licence;
- reverse engineer, decompile or disassemble the Game, or try to extract its source code;
- extract, reuse or redistribute the Game’s art, models, music, sound or other assets, including to train machine-learning models;
- remove or alter any copyright, trademark or other notices in the Game; or
- use the Game for anything unlawful.
4. Videos, streams and screenshots
You can stream the Game, make videos of it, share screenshots and earn money from that content through the platforms you publish on. We love seeing it, and a link back to the Game is appreciated. Please don’t suggest that Moonjump endorses or sponsors your content unless we’ve agreed to it.
5. Ownership
The Game and everything in it, including its code, art, characters, music, sound, text and the Haul Yeah! name and logo, belong to Moonjump or our licensors. Third-party components are used under their own licences, which are listed in the Game’s credits where they require it.
6. Updates
We may release patches, updates and new content for the Game. Some updates may be needed to keep playing. This Agreement applies to them too.
7. Your consumer rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service. If you live outside Australia, the consumer protection laws of your country also apply, and nothing in this Agreement limits them.
8. Warranty and liability
To the extent the law allows, the Game is provided “as is”, and we don’t promise it will be free of bugs or always available. To the extent the law allows, our total liability to you in connection with the Game is limited to the amount you paid for it. We aren’t liable for indirect or consequential loss. Nothing in this Agreement excludes or limits any liability, guarantee, right or remedy that can’t be excluded or limited by law, including under the Australian Consumer Law.
9. Health and safety
A very small number of people may have a seizure when exposed to flashing lights or patterns, including in video games, even with no history of epilepsy. If you or anyone in your family has an epileptic condition, consult a doctor before playing. Stop playing straight away and see a doctor if you feel dizzy, have blurred vision, eye or muscle twitches, disorientation or any involuntary movement. Take regular breaks.
10. Ending this Agreement
This Agreement lasts until it ends. You can end it at any time by uninstalling the Game and deleting all copies. It ends automatically if you seriously break its terms. When it ends you must stop using the Game. Sections 5, 7, 8 and 11 continue to apply.
11. Governing law
This Agreement is governed by the laws of the Australian Capital Territory, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. If you live outside Australia, you keep any protection given to you by the mandatory laws of your country.
12. Changes
We may update this Agreement, for example when the Game comes to a new platform. The date at the top of this page shows the latest version. Changes won’t reduce your rights for content you’ve already bought. The Haul Yeah! privacy policy explains how the Game handles information.
